Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Simple PMS platform (“Service”), operated by Simple PMS (“we”, “us”, “our”), based in Albania. By creating an account or using the Service, you agree to be bound by these Terms.

1. About the Service

Simple PMS is a SaaS platform for short-term rental hosts. It provides booking management, AI-powered check-in instruction generation, WhatsApp guest communication, smart lock integration, digital guest registration, expense tracking, and related property management features through a Progressive Web App (PWA).

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using Simple PMS, you represent that you meet these requirements.

3. Account Registration

You must create an account to use the Service. Authentication is handled through Clerk. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Plans and Pricing

Simple PMS offers a Free plan and a paid Pro plan. The Free plan includes limited features and property limits. The Pro plan provides unlimited access to all features at the price listed on our website.

Prices may change with 30 days' prior notice. Payments are processed through Stripe. All fees are in Euros (€) and are non-refundable except as required by applicable law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights of others
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with unauthorized third parties
• Use the Service to store sensitive personal data beyond what is necessary for property management operations

6. Your Data

You retain ownership of all data you upload to Simple PMS, including booking records, guest information, property details, and expense records. We do not claim ownership of your content.

You grant us a limited license to process, store, and display your data solely to provide the Service. You may export or delete your data at any time.

7. Guest Data and GDPR

When you use Simple PMS to collect and store guest personal data (names, ID documents, contact information), you act as the data controller. We act as the data processor. You are responsible for ensuring you have a lawful basis to collect guest data and for complying with applicable data protection laws including GDPR.

ID document images are stored with configurable auto-deletion periods to support GDPR compliance. See our Privacy Policy for details.

8. AI Features

Simple PMS uses AI (Google Gemini) for booking extraction, ID document scanning, check-in message generation, and the WhatsApp chatbot. AI outputs are provided as suggestions and may contain errors. You are responsible for reviewing and verifying all AI-generated content before use.

9. Third-Party Integrations

The Service integrates with third-party services including Clerk (authentication), Stripe (payments), Meta WhatsApp Business API (guest messaging), Seam (smart locks), and Cloudflare R2 (file storage). Your use of these integrations is subject to their respective terms of service.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided “as is” and “as available.” We may perform maintenance or updates that temporarily affect availability.

11. Limitation of Liability

To the maximum extent permitted by law, Simple PMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, bookings, or data, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Albania. Any disputes shall be resolved in the courts of Tirana, Albania, unless otherwise required by applicable consumer protection law.
